Because of the intimate connection with life, health can be considered as a worth individual, collective and which is closely related with the principle of human dignity, one of the foundations of the Brazilian state. The exposure of the subject has the propose to contextualize the Democratic State of law as a paradigm for solving social conflicts, emphasizing the possibility of recover the concrete rights and guarantees, with focus on social rights, especially in relation with the right to health, through the protects jurisdictional collective.'
